Terms & Conditions
These Terms & Conditions ("Terms") govern your access to and use of The Micro Event Kit ("the Service"), an interactive event-planning tool provided by My Virtual Newton ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Who you are contracting with
The Service is operated by My Virtual Newton. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
2. Acceptance of these Terms
By accessing or continuing to use the Service, you accept these Terms. If you do not agree, please do not use the Service.
3. Acceptable use
You agree not to misuse the Service, including but not limited to:
- using the Service for any unlawful purpose, fraud, or spam;
- infringing our intellectual property or the rights of others;
- interfering with the security of the Service, including malware, probing or scraping;
- sharing your account with others or reselling access to the Service.
4. Intellectual property
The Service — including its software, planning frameworks, written content, templates and branding — is owned by My Virtual Newton and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for planning your own events. You may not redistribute, resell or sublicense the content.
You retain ownership of the answers, plans and content you create in the Service. You grant us a limited licence to host and process that content solely to provide the Service to you.
5. Purchases, payment and refunds
The Service is offered as a one-time purchase that unlocks full access on your account. Payment, billing, tax, cancellation and refund mechanics are handled by Paddle as Merchant of Record; see Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms) and our Refund Policy at /refund.
6. Service level
The Service is provided "as is". We do not guarantee that the Service will be uninterrupted or error-free, and we disclaim implied warranties of merchantability and fitness for a particular purpose to the fullest extent permitted by law.
7. Account security
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Please provide accurate information and keep it updated.
8. Limitation of liability
To the fullest extent permitted by law, our aggregate liability to you is limited to the fees you paid us in the twelve months before the claim, and we exclude liability for indirect, consequential or special damages, including lost profits or data. Nothing in these Terms excludes liability that cannot be excluded by law.
9. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious policy violations. If your access ends, you will have a reasonable window to export the content you created before it is deleted.
10. Changes
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
